GENERAL INFORMATION AND SERVICES :
- The SMS for which you are signing is partly free and a few chargeable. The charges levied as subscription fees are for the costs involved in delivering the messages to your mobile or for the administrative purpose.
- The SMS may or may not contain promotional messages along with the services you have subscribed to. Currently, these services are available in India only. If in case you have not read these conditions and paid us from outside the country, applicants are not liable for any refund.
- Any person whether in India or outside registering or communicated with RAKU RAKU through any of its portals or services are liable to get promotional mails or SMS or any other such communications and it should not be viewed as Unsolicited Commercial Communication(UCC).
- These messages are under the clause and relates to a service or financial transaction under a specific contract between the parties to such contract under National Do Not Call Registry or any other international law. If they wish not to receive such messages, it should be communicated well in time.
- The delivery of SMS depends on various factors including that of the services provided by mobile operators and bulk SMS providers. Any delay or non-delivery, though very restricted, will not be the responsibility of RAKU RAKU. The time to deliver the SMS is dependent upon the traffic on the mobile network and whether the applicant’s mobile phone is within reach and switched on and cannot therefore be guaranteed by Commodity Online India Limited. Since we are not a mobile network operator we do not guarantee the delivery of SMS text messages.
- The applicants to these services confirm that they have provided the accurate mobile number to be reached by SMS and the applicant is the owner or its legitimate user, or that the applicant has the consent of the owner or legitimate user, of the mobile phone using for the Services.
- The applicant of the services offered by RAKU RAKU acknowledges that using another person's mobile phone/providing inaccurate mobile phone number/unauthorized use of mobile phone number for receiving the SMS may entail disclosure of applicant ‘s confidential information which disclosure shall be at the sole risk of the applicant
- Applicants must not use (or permit any third party to use) the SMS Service to send any message or communication which is Spam, illegal, offensive, abusive, indecent, obscene or menacing or causes annoyance, inconvenience or needless anxiety or infringes the rights of third parties. RAKU RAKU reserves the right to withdraw the SMS service to such applicants if they breach this condition.
- The applicant acknowledges that the SMS Services may, at any time, be adversely affected by problems with the applicant’s mobile phone network, including, without limitation, interference to the network coverage. RAKU RAKU is not responsible or liable to the applicant for any loss, damage or expenses incurred directly or indirectly.
- The applicant shall at its sole risk be responsible for taking all reasonable steps to prevent unauthorized persons gaining access to the services. You are also not allowed to distribute these services at your end, breach of which will be liable for legal action.
- RAKU RAKU in its sole discretion can temporarily suspend the provision of the services if such provision could materially affect the quality of any telecommunications service, including the Services, provided by RAKU RAKU.
- These terms and conditions shall be governed and construed in accordance with the laws of India. The applicants acknowledge that there will not be any claims or disputes arising in relation to the services provided by RAKU RAKU. If it does, it will be subject to the exclusive jurisdiction of competent courts in Mumbai only.
- We may modify these Terms at any time at our sole and absolute discretion, and such modifications shall be effective immediately upon posting of the modified Terms. You agree to review the Terms periodically to be aware of such modifications and your continued access to and/or use of the RAKU RAKU SMS shall be deemed your conclusive acceptance of the modified Terms.
- All information/data and materials available on RAKU RAKU SMS is under copyright to us .The copyrights of third parties, including but not limited to our supporting service vendors are also hereby reserved. The information/data and materials are accessible for browsing purposes only.
